Expungement is the legal process in the State of California where a criminal conviction is dismissed. Expungement is the legal way of getting a guilty plea, a no contest plea or a finding of guilt by a judge or jury set aside and the case is dismissed. At the end of the process, an Expungement relieves the defendant of specific penalties and disabilities that were the result of the criminal action prosecuted against them. The arrest, prosecution and conviction records will remain in the court file, but a notion is put into the file and noted that the conviction has been dismissed. Inside your court file there will be a notation that says the California Department of Justice and the Federal Bureau of Investigation files will reflect that a plea of not guilty was entered and the case ordered to be dismissed by the court. The file is still there, it has not been destroyed, but the information in that file cannot be used to keep you from getting a job based on a conviction in court.
